TERMS OF PURCHASE, REFUND POLICIES, and WAIVER

These terms govern purchase of your event ticket from The West Collective, LLC, an Arizona limited liability company ("The West Collective", "we", "us", and "our"; the “Company”) by purchaser (“Purchaser”; “Attendee”; “You”; “Your”; “Participant”) for our Event, The Table Experience (the “Event”). When you make a purchase, you're agreeing to these terms and any others found on our website or shared with you. Please read carefully before completing your purchase. By completing your purchase, you agree to be bound by all of these terms: 

Introductory Terms: 

  • You must be 18 or older to make a purchase.

  • Our website, community, and events are hosted using the following platforms: Squarespace and Zoom. These platforms have their own separate terms and privacy policies.  

  • Our Privacy Policies can be located at the footer of our website. Please review before completing a purchase. 

  • ADA: Our events are held at third-party owned and managed venues. It is our goal to make our events accessible to all. If you require a reasonable modification or accommodation to participate in our programming as provided under the American Disabilities Act (ADA), please contact us as soon as possible at haley@haleywestfall.com so we may work with you and the venue to determine possible accommodations.

  1. REFUND POLICIES & PURCHASE TERMS: ALL TICKET SALES ARE FINAL AND NON-REFUNDABLE. The ticket fee is consideration not only for the services delivered at our event, but also for your dedicated seat and our time and preparation that goes into every Attendee. Event Tickets may be transferred by giving at least seven (7) days advance notice to us at the email address below. The transferee of any Ticket shall also be bound by these terms. Each ticket admits only one (1) individual. 

The Event Experience: Our goal is to deliver the Event of your dreams, just as advertised. However, there are many moving parts, vendors, and venue operators that we are relying on, and unforeseen circumstances can arise. We may modify schedules, itineraries, keynotes, speakers, activities, or the location of the event at our sole discretion. We will promptly inform you of any delays or changes that impact the schedule or those caused by unforeseen circumstances and the alternative arrangements we have determined. We reserve the right to limit or cancel orders, adjust availability, and change offerings or prices without notice. All offers are void where prohibited. While we strive for accuracy, descriptions may contain errors. Event tickets are non-refundable, even if there are changes. Individual experiences may vary, and we do not guarantee specific results. We encourage active participation and a positive attitude for the most fulfilling experience.

Pricing and Payment: The prices displayed on our platform are subject to change, and the price as advertised at the time of purchase is the price applicable to you. Payment must be made at the time of purchase using the currently displayed accepted payment methods.

Ticket Payment Plans: We do not guarantee an offering of a payment plan, but from time to time we may offer a “payment plan” for event tickets. This is not a subscription, and payment in full is due for every ticket purchased at the time the purchase is made. Failure to complete a payment plan as scheduled will result in your ticket being canceled, but does not cancel your obligation to pay. 

  1. WAIVER: By purchasing this ticket, and/ or attending the Event you represent that you are physically able to participate in the Event as described on the Company’s website/ platform. If there is any part of the programming that you are not comfortable with or do not feel that you can participate in, you understand that it is your sole responsibility to refrain from participation in that portion. By making a purchase and participating in any events or activities associated with the event, you hereby release and forever discharge The West Collective, LLC, its officers, directors, employees, volunteers, agents, and representatives, as well as the owners, operators, and managers of any event venue (collectively, the "Released Parties"), from any and all liability, claims, demands, actions, or causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by you or to any property belonging to you, whether caused by the negligence of the Released Parties or otherwise, while participating in any activity or event related to The Table, The Table Experience, and The West Collective. Participant expressly agrees to indemnify and hold harmless the Released Parties from any and all liability for any such loss, damage, or injury. This waiver applies to all events and activities, whether held on the premises of a venue or elsewhere. Participant acknowledges that there are inherent risks associated with participation in events and activities, and voluntarily assumes all known and unknown risks.

By participating in the Event, you agree that an inherent risk of exposure to communicable disease exists in any public place where people are present. By attending in person events, you voluntarily assume all risks related to exposure to communicable disease, and you release The West Collective of any related liability.

You agree to follow the rules and guidelines set by The West Collective, program facilitators, its representatives, and the facility whether given verbally, in the program materials, and/or as communicated on the Company platforms. 

Participants are solely responsible for the safety and security of their personal belongings brought to the Event. The West Collective is not responsible for any loss, theft, or damage to personal property.

  1. PARTICIPANT CONDUCT: The Table is known for creating positive and fulfilling experiences for everyone, and we aim to continue fostering such an environment. To ensure all participants can enjoy the Event to its fullest, participants  are expected to conduct themselves in a respectful and considerate manner towards all other attendees, presenters, venue staff, and The West Collective representatives throughout the Event. This includes being mindful of noise levels, refraining from interrupting speakers, and treating everyone with courtesy and professionalism. Any behavior deemed disruptive, offensive, or otherwise inappropriate by The West Collective may result in you being asked to leave the Event without a refund. We appreciate your cooperation in making this another successful and enriching experience for all.

  2. MEDIA RELEASE AND TESTIMONIALS: The West Collective may engage professional photographers and videographers at the Event. Unless otherwise specifically advertised (such as free headshots for some events), these professionals are solely in attendance to capture media for the Company ’s purposes, and you agree not to interfere with their work or make specific photo or video requests. For the purposes of these terms “Media” is defined as photographs, video recordings, audio recordings, and/ or written content capturing your likeness, voice, or words. With your purchase and attendance to the Event, including any related workshops or activities organized by The West Collective, its affiliates, or its facilitators you grant to the Company a worldwide,  irrevocable, perpetual, and unrestricted right and license to use, reproduce, edit, modify, publish, distribute, and publicly display any and all Media for any purpose the Company  deems appropriate, including but not limited to promotional, advertising, educational, and testimonial purposes. This grant is without any obligation on the part of the Company  to provide you with any compensation, royalties, or any other form of payment. You further grant the Company  the irrevocable right to use your words as testimonials in any form. You waive any right to inspect or approve the Media. By purchasing a ticket and participating, you hereby release and forever discharge the Company  from any and all claims and liabilities arising from or related to the Company 's use of Media and testimonials.

  3. USER ACCOUNT: Your submission of personal information is governed by our Privacy Policy, which can be viewed on the footer of our site and the Privacy Policy of our hosting platforms stated above. To make a purchase, you may be required to create an account. You are solely responsible for maintaining the confidentiality of your account and password. 

  4. LIMITATION OF LIABILITY: OUR LIABILITY FOR LOSSES YOU SUFFER AS A RESULT OF US BREACHING THESE TERMS IS STRICTLY LIMITED TO THE PURCHASE PRICE OF THE CURRENT TICKET PRICE. IN NO CASE WILL THE WEST COLLECTIVE, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, FACILITATORS, AGENTS, CONTRACTORS, INTERNS, SUPPLIERS, SERVICE PROVIDERS, OR LICENSORS BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICE OR ANY PRODUCTS PROCURED USING THE SERVICE, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICE OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICE OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICE, EVEN IF ADVISED OF THEIR POSSIBILITY. BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR THE LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, IN SUCH STATES OR JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

  5. INTELLECTUAL PROPERTY RIGHTS: All copyrights, trademarks, and other intellectual property rights associated with our offerings and the content available on our platforms are either owned by us or utilized under license, and are fully protected by applicable law. Your purchase grants you a limited license for personal use only. Any commercial redistribution of our intellectual property is strictly prohibited without prior written consent. Furthermore, unauthorized reproduction, distribution, or creation of derivative works is strictly forbidden. By submitting any content to us, including but not limited to creative ideas, suggestions, or requests, you grant us an irrevocable, royalty-free, worldwide license to utilize, modify, reproduce, and distribute that content in any manner we deem appropriate. Please note that we are under no obligation to maintain the confidentiality of your submissions, provide compensation for them, or respond to any communications related to them.

  6. ELECTRONIC COMMUNICATIONS:  By completing a purchase you consent to receiving communications from us via email and text message regarding your account, purchases, and/ or for marketing purposes as permitted by applicable law, and consistent with our Privacy Policy, which can be found on our website.  

  7. FORCE MAJEURE. The Company  shall not be liable for any delay or failure to perform its obligations under this Agreement due to any cause beyond its reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, civil unrest, embargoes, strikes, lockouts, or other labor disputes, epidemics, pandemics, governmental regulations, fire, explosion, flood, or any other event of a similar nature or magnitude (each, a "Force Majeure Event").  

In the event of a Force Majeure Event, the Company  shall promptly notify the ticket Purchaser, in writing, of the nature and extent of the Force Majeure Event. The Company  may, in its sole discretion, either: (a) reschedule the event to an alternative date within 24 months of the end of the Force Majeure Event, when possible; or (b) offer alternative means for the Purchaser to participate in the event, such as through a virtual platform. Any such alternative dates or means for the event are not required to be the same as the original event.

The Company  shall not be required to issue refunds for tickets purchased in the event of a Force Majeure Event, provided that the Company  has offered alternative dates or alternative means for participation in the event as described in this clause.

  1. MODIFICATION OF TERMS: The Company reserves the right to modify these terms at any time after your purchase. Should we modify the terms, we will notify ticket holders by email. By attending and participating in the Event, you agree to be bound by these and any modification of these terms. 

  2. SEVERABILITY: If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall 1 remain in full force and effect.

  3. GOVERNING LAW AND JURISDICTION: These terms are governed by the laws of the State of Arizona and any disputes will be subject to the exclusive jurisdiction of Maricopa County, Arizona. 

By proceeding with your ticket purchase, you acknowledge that you have read, understood, and agree to be bound by these Terms of Purchase. A breach or violation of these Terms may result in an immediate cancellation of your ticket without refund and revocation of all licenses granted to you through our services.
